MX Design Studio – Terms & Conditions

By engaging with MX Design Studio for design, marketing, printing, or related services, the client agrees to the following Terms & Conditions.

MX Design Studio provides marketing, graphic design, printing, promotional, and custom creative services.
The client agrees to supply all content (text, images, logos, etc.) required for the project in a timely manner.
MX Design Studio reserves the right to update these Terms & Conditions at any time.
The laws of the Republic of South Africa shall govern these Terms.

Digital Design Services: 100% upfront payment is required before work commences.
Printing Services: A 70% deposit is required before printing begins. The balance (30%) must be paid before collection or delivery.
Work will not proceed until required payment is received.
All payments are non-refundable once work has commenced.
Additional costs (e.g., stock images, special fonts, courier fees) will be quoted separately and invoiced.
Prices are subject to an annual increase effective 1 March each year.

Clients will receive artwork proofs for review and approval before finalization.
It is the client’s responsibility to check all spelling, grammar, colours, logos, contact details, and layouts.
Once artwork is approved by the client (verbally, in writing, or via email), MX Design Studio is not liable for any errors, omissions, or dissatisfaction arising thereafter.
Any revisions or reprints required after approval will be charged in full to the client.

By providing content (text, images, logos, etc.), the client confirms they hold the rights or have permission to use such material.
MX Design Studio retains ownership of all design concepts, drafts, and source files until full payment has been received.
Once fully paid, the client is granted usage rights to the final approved design.
MX Design Studio reserves the right to showcase completed projects in its portfolio, website, or marketing unless agreed otherwise in writing.
The client indemnifies MX Design Studio against claims arising from copyright/trademark infringement on supplied content.

Projects include up to two (2) rounds of minor revisions unless otherwise agreed.
Additional changes beyond the agreed scope will be billed separately at an hourly/design rate.
MX Design Studio is not responsible for amendments made by third parties after delivery.

Project timelines are estimates and may vary depending on client responsiveness, approvals, and external factors.
Turnaround times for printing or delivery begin only after deposit/full payment and final artwork approval.
MX Design Studio is not liable for delays caused by suppliers, couriers, or force majeure events.

MX Design Studio reserves the right to refuse content deemed offensive, unlawful, or inappropriate.
All advertising material must comply with relevant advertising and legal standards.

Cancellations must be submitted in writing.
If a project is cancelled after commencement, payments already made are non-refundable.
Refunds will not be issued once design work has started or printing has been executed.

MX Design Studio makes no warranties, express or implied, regarding final results.
While every effort will be made to deliver high-quality work, MX Design Studio is not liable for:
- Errors in artwork after client approval.
- Colour variations between on-screen proofs and final prints.
- Delays or damages caused by third-party vendors or shipping.
- Consequential or indirect losses.
Any claim is limited to the value of the services provided and paid for.

These Terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to the jurisdiction of South African courts.
